For the purchase price, purchaser may pay cash, or may pay 10% of the purchase price in cash, with the balance of the purchase price secured by a purchase money bond due in thirty (30) days, with good and approved surety on the bond, and bearing interest at the rate of 3.25% per annum from date of sale until paid, said bond to have the same force and effect as a judgment and remain a prior and superior lien on the property until fully paid. The property shall be sold with the improvements thereon, "as is" and specifically subject to easements, restrictions and stipulations of record, assessments for public improvements levied against the property, and any facts which an inspection and accurate survey of the property may disclose. Bidders shall be prepared to promptly comply with the terms of sale; purchaser shall pay property taxes due for 2017 and following years.
The judgment authorizing the sale is a Judgment and Order of Sale in Barren Circuit Court Civil Action No. 17-CI-265, FRANKLIN AMERICAN MORTGAGE COMPANY vs. SCOTT W. NEELY to recover the amount of $96,611.06, together with interest at the rate of 3.25% per annum from September 1, 2017 until paid, including attorney’s fees approved by the court, and costs herein expended.
